The injured person can collect funds for the damages from his insurance company if the other driver had been carrying insurance. In most states, insurance companies are required to offer uninsured motorists coverage where the policyholder can wave the coverage in writing (uninsured motorists coverage must be included in a few states.)
This coverage also include hit-and-run vehicles and persons, yet this coverage does not apply if the negligent party does not have adequate limits to fully cover innocent party.
Limits of uninsured motorists coverage are as follows:
__ Innocent victim (not the uninsured driver) bears the cost of coverage
__ The insured person must establish that the uninsured party was legally liable
__ The limits of coverage are equal only to state's compulsory insurance unless the policyholder purchased higher limits
__ Coverage usually applies to bodily injury only (where the coverage for the property damage vary among the states)
